This appeal is from a conviction for unauthorized use of a motor propelled vehicle, where the punishment was assessed at life imprisonment under V.T.C.A., Penal Code, ? 12.42(d). The panel opinion on original submission held that the State had the burden of proving all the elements of the offense charged and the State failed to prove as it was required to do that the appellant knew the vehicle he was driving was stolen in order to show that he intentionally and knowingly operated the vehicle without the owners consent. There was a vigorous dissenting opinion by Judge Dally.
